Most discussions of Spinoza and consciousness—and there are not many— conclude either that he does not have an account of consciousness, or that he does have one but that it is at best confused, at worst hopeless. I argue, in fact, that people have been looking in the wrong place for Spinoza's account of consciousness, namely, at his doctrine of "ideas of ideas". Indeed, Spinoza offers the possibility of a fairly sophisticated, naturalistic account of consciousness, one that grounds it in (...) the nature and capacities of the body. Consciousness for Spinoza, I suggest, is a certain complexity in thinking that is the correlate of the complexity of a body, and human consciousness, for Spinoza, is nothing but the correlate in Thought of the extraordinarily high complexity of the human body in Extension. In this respect, Spinoza anticipates the conception of mind that is presently emerging from studies in the so-called ‘embodied mind’ research program. In 1949, Kurt Gödel found a solution to the field equations of general relativity that described a spacetime with some unusual properties. This “Gödel universe” permitted “closed timelike curves,” hence a kind of time travel, and it did not admit of decomposition into successive moments of time. In the same year, he published “A Remark about the Relationship between Relativity Theory and Idealistic Philosophy”, in which he used certain properties of this solution to argue for a kind of temporal idealism, (...) whereby “change [is] an illusion or an appearance due to our special mode of perception”. The paper is short and to the point, but the argument has usually been regarded as fatally flawed. Abstract:In this paper, I show that certain parts of constitutional texts can plausibly be thought of as having a meaning that changes and evolves on its own. This idea is widely rejected, especially but not only by a group of legal theorists who subscribe to a theory of constitutional interpretation called originalism. In a recent paper, the originalist Lawrence Solum has defended the so-called “fixation thesis”, according to which the meaning of the constitutional text is fixed when it was first (...) enacted and does not change later on. Solum rejects the idea that the meaning of the constitutional text might evolve because he cannot identify a plausible way in which any text could have an evolving meaning. I argue that there are such texts and offer folk-fairy-tales as an example. I then go on to present reasons why constitutions can plausibly be considered to be texts that, like fairy-tales, change their meanings independently. (shrink)

Este artículo identifica los principales antecedentes legislativos y jurisprudenciales de la evidencia digital en Colombia, con miras a detallar su tratamiento en el proceso judicial; así mismo, pretende evidenciar cómo opera la cláusula de exclusión, y de qué manera se protege el derecho a la intimidad, en la obtención de evidencia digital, desde distintos medios de almacenamiento. La metodología es cualitativa y se utilizó la técnica de la revisión documental y la entrevista a expertos, para mostrar una realidad respecto a (...) una problemática de valoración de las pruebas tecnológicas, en los casos de ilicitud, y brindar aportes para mejorar la comprensión y la dimensión de su práctica en el proceso judicial. La principal conclusión es que no se le puede negar eficacia y validez probatoria por estar en forma de bytes, siempre y cuando se pueda establecer la autenticidad del contenido y la correspondencia con el autor. The latter is exposed in Book VI of the Quesiti et invention diverse (hereafter Quesiti). In Quesiti there is La Gionta del sesto libro—a kind of appendix to the Book VI containing drawings of the geometric shape of the Italian fortifications. It is based on Euclidean geometry and other figures where a scale is (...) displayed. The interest—included intellectual history and cultural foundations of science—is: what is the role–played by La Gionta del sesto libro in the Quesiti? Is it independent booklet/speeches? If yes, when Tartaglia did write it? In this paper, I present an historical–philological–foundational hypothesis on the Tartaglia’s fortifications corpus, as exposed in the Book VI and La Gionta del sesto libro; with respect to dates of editions of Quesiti (1546, 1554). This goal is important to make historically clear both the editorial role–played by Curzio Troiano Navò (fl. 16th) in the Tartaglia’s corpus before—after Tartaglia’s death (1557) and the particular interest and development of subject of fortifications by Tartaglia between 1537–1546 and 1554. In the De musica’s sixth Book Augustin puts the question of the knowledge’s nature from the description of the rhytmical movements experienced by the subject. This is the beginning of a cognitive process that starts from the numers’ traces and ends with the inquiry about the conditions of knowledge’s possibility, giving impulse to a research on several levels. The article’s purpose is to understand the most important implications of the Augustinian cognitive paradigm, that doesn’t seem to be a mere numerical logic but allow us to take a philosophical glance to the creature’s metaphysical truth. La fine del mondo costituisce uno dei temi centrali del De rerum natura, testo che rappresenta inoltre la nostra principale fonte sull'escatologia cosmica epicurea. Mosso dall'intento d'indagare questo aspetto cruciale (che non è mai stato in precedenza oggetto di studi monografici), questo libro propone un commento delle principali sezioni escatologiche del poema: i finali del primo e del secondo libro, i vv. 91-415 del quinto e la rassegna dei fenomeni meteorologici più violenti nel sesto. L'analisi delle fonti filosofiche e (...) degli obbiettivi polemici permette di dare risposte alla questione del "fondamentalismo" di Lucrezio, ponendo inoltre le basi per un esame del suo peculiare "sublime apocalittico". Le appendici forniscono ulteriori considerazioni sull'immaginario escatologico lucreziano, concentrandosi sul modello offerto da Empedocle, le strategie comunicative del poeta e la possibile influenza del trattato pseudo-aristotelico De mundo. Questo esame mostra che il poeta richiama dottrine e fonti filosofiche successive a Epicuro, senza però cadere nell'eclettismo: uomo del suo tempo, Lucrezio "attualizza" le dottrine del maestro, proponendole come risposta per le angosce della propria epoca. El objetivo de este artículo es demostrar que la obra del sociólogo del conocimiento científico Steven Shapin es heredera del debate internismo/externismo. Esa herencia se expresa a través de los intentos que realiza por romper los límites de las dicotomías que fueron construidas en el curso de la controversia en los ámbitos disciplinares de la historia de la ciencia, la sociología de la ciencia y la sociología del conocimiento científico. Abordaremos principalmente las cuestiones concernientes a la relación entre la (...) obra de Shapin de los años noventa y los trabajos de Robert Merton, uno de los pilares del debate.The aim of this paper is to show that the work of the sociologist of scientific knowledge Steven Shapin is inheriting from the internalism/externalism debate. That inheritance is expressed by the attempts that he makes to break the boundaries of the dichotomies, which were built during the dispute in the disciplinary fields of history of science, sociology of science and sociology of scientific knowledge. We will deal with the issues concerning the relation between Shapin’s work during the nineties and Robert Merton’s work, which was one of the pillars of this debate. (shrink)

There is a credibility decay on positive knowledge among the social scientists and particularly among the psychologists. Certainly different prejudices dwell upon this phenomenon. First and principal the usually made identity of positive and natural knowledge. This belief is also fed by many others such as that one which assumes that every quantification, which is a consequence of positive knowledge,follows the model of the Physical Sciences. We consider that all these prejudices do not keep in mind the work done in (...) the last decades on the Theories of Measure. We consider also that psychophysical methods which have been introduced by Stevens present a stimulating program for the behavioral sciences and they open a new frontiere to the positive knowledge. Experimental philosophy is a relatively recent discipline that employs experimental methods to investigate the intuitions, concepts, and assumptions behind traditional philosophical arguments, problems, and theories. While experimental philosophy initially served to interrogate the role that intuitions play in philosophy, it has since branched out to bring empirical methods to bear on problems within a variety of traditional areas of philosophy—including metaphysics, philosophy of language, philosophy of mind, and epistemology. To date, no connection has been made between developments in experimental philosophy (...) and philosophy of technology. Vice essentialism is the view that epistemic vices have robustly negative effects on our epistemic projects. Essentialists believe that the manifestation of epistemic vices can explain many of our epistemic failures, but few, if any, of our epistemic successes. The purpose of this paper is to argue that vice essentialism is false. In §1, I review the case that some epistemic vices, such as closed-mindedness and extreme epistemic deference, have considerably beneficial effects when manifested in collectivist contexts. In §2, I (...) add that there are putative epistemic vices whose repeated manifestation leads to significant epistemic achievements over time. Epistemic recklessness is one such unstable vice. Though Sosa argues that epistemically reckless judgements cannot constitute knowing full well, the repeated manifestation of epistemic recklessness is essential to our becoming fully well knowledgeable in the long run. Without making incompetent judgements in environments that offer unambiguous, actionable feedback, we could not develop the intuitive and reflective competences and meta-competences required for knowing full well. The international debate on the ethics and legality of autonomous weapon systems (AWS), along with the call for a ban, primarily focus on the nebulous concept of fully autonomous AWS. These are AWS capable of target selection and engagement absent human supervision or control. This paper argues that such a conception of autonomy is divorced from both military planning and decision-making operations; it also ignores the design requirements that govern AWS engineering and the subsequent tracking and tracing of moral responsibility. (...) To show how military operations can be coupled with design ethics, this paper marries two different kinds of meaningful human control (MHC) termed levels of abstraction. Under this two-tiered understanding of MHC, the contentious notion of ‘full’ autonomy becomes unproblematic. (shrink)

Esta investigación tiene como objetivo la reconstrucción del concepto de terror en la primera década del siglo XX. La delimitación temporal se debe a que en ese lapso se publicó un compendio de relatos de tópico terrorífico, intitulado Cuentos malévolos (1904), del escritor peruano Clemente Palma. Para lograr la configuración semántica del término aludido, se recurre a la documentación de fuentes periodísticas de ese entorno (como El Comercio, La Prensa, Variedades, entre otros), para respaldar la percepción asumida del mismo. A (...) través de la confrontación de estos discursos, es notoria la influencia que recibe el autor por parte de las temáticas derivadas, como la asociación del terror con la criminalidad o el oscurantismo que se desenvuelven por personas desequilibradas. Igualmente, la ideología y la filosofía que se extraen se vinculan con el ateísmo y todo lo que critica y cuestiona los dogmas de la religión judeocristiana. (shrink)

An incisive and witty probe into ethics of the academic world.

This paper examines three programmatic responses to the problem of cognitive bias: virtue epistemology, epistemic paternalism, and epistemic collectivism. Each of these programmes focuses on asinglelevel of epistemic analysis: virtue theorists on individuals, paternalists on environments, and collectivists on groups. I argue that this is a mistake in light of the fact that cognitive biases arise frominteractionsbetween these three domains. Consequently, epistemologists should spend less time defending these programmes, and more timecoordinatingthem. This paper offers empirically based arguments for the interactionist (...) approach, and contends that its adoption is an essential step for minimizing bias in empirical science. (shrink)

Though the literature on care ethics has mushroomed in recent years, much remains to be said about several important topics therein. One of these is action. In this article, I draw on Anscombean philosophy of action to develop a kind of meta- or proto-ethical theory of caring actions. I begin by showing how the fragmentary philosophy of action offered by care ethicists meshes with Elizabeth Anscombe's broader philosophy of action, and argue that Anscombe's philosophy of action offers a useful scaffold (...) for a theory of caring actions. Following this, I defend an account of caring actions as those that aim to meet needs. I argue that care aims at satisfying eudaimonistic needs, those things without which one cannot flourish. I then consider the place of caring actions in care ethics. I suggest that if caring actions are to be a starting point for an ethical theory, we ought to reject the notion that a caring action must bring about its intended consequences, and I show how the concept of practice better equips us to evaluate caring actions. Contributors to the 2016 Special Issue of Discourse Studies on the ‘Epistemics of Epistemics’ claim that studies of epistemics in interaction have lost the ‘radical’ character of groundbreaking work in ethnomethodology and conversation analysis. We suggest that the critiques and related writings are a kind of mandarin EM, lacking an adequate definition of ‘radical’, other than to invoke brief and by now familiar statements from Garfinkel and Sacks regarding the pursuit of ‘ordinary everyday activities’ and the avoidance of ‘formal analysis’. (...) Drawing on Egon Bittner’s work, we further suggest that the EoE group shares properties and problems common to social movements claiming the mantle of radicalism. Because of their particular focus on CA and Harvey Sacks’ early work, we also demonstrate that Sacks was not, as asserted, preoccupied with the singularity of occasions. Rather, from his earliest available work, Sacks pursued trans-situational aspects of sequential organization, and documented these not only through single cases but also through the comparative analysis of specimen collections. We conclude by considering how EM and CA are compatible endeavors, both in their engagement with traditional research topics – or what Garfinkel called ‘asymmetric alternates’ – and in their appreciation of generic features implicated in the assembly of social actions and social worlds. This implies a relationship of mutual interchange between EM and CA. (shrink)

Este artículo revisa el modo en que la aparición de objetos críticos, como el Portabotellas de Duchamp, hacen entrar en crisis las nociones tradicionalmente aceptadas respecto de la obra de arte: su manualidad (la “buena factura”, producto de la destreza o habilidad del artista), su función representativa (mímesis) y su valor estético (el ser “bello”, objeto de una contemplación pura y desinteresada). Se plantea, así, que la aparición del ready made configura el momento final de un proceso de disolución de (...) las convenciones artísticas (tanto respecto de la producción como de la valoración de las obras de arte) imperantes hasta el momento. Teniendo en cuenta todo esto, la pregunta que se intenta responder, al final, es: ¿cómo es posible que algo como el Portabotellas pudiera haber sido aceptado como arte, si no cumplía con las condiciones básicas de la noción tal y como se la aceptaba entonces?
